PATENTS

In most countries it is necessary to pay ‘renewal’ fees periodically in order to maintain a granted patent. For most countries, patents have a maximum term of 20 years from filing, after which the rights terminate.

Our firm can assist patent owners with their renewals in Australia and New Zealand. We have a network of trusted international advisors enabling us to renew patents outside of Australia and NZ for our clients.

We utilise advanced online tools to monitor deadlines, assume responsibility for timely payment of applicable renewals fees in Australia and New Zealand and liaise with our international colleagues to ensure client’s IP portfolios are well managed in each jurisdiction, adhering to each country’s requirements.

AUSTRALIA

For protection rights to remain in force, renewal fees are payable on all standard (granted and pending) and innovation patent applications. 

Annual fees are due on or before the fourth anniversary of the filing date of the complete application for a standard patent and annually until the patent ceases.

The official renewal fee increases in amount payable as a patent ages. 

For an innovation patent application the first renewal fee is due two years from the filing date

NEW ZEALAND

Annual fees are due on or before the fourth anniversary of the filing date of the complete application for a standard patent, and annually thereafter.

UNSOLICITED INVOICES

Please note, if you have received a request for payment for renewal fees from a company that is not associated with us, please proceed with caution. As applicant name and address details are readily available on various public databases, unfortunately, you may be targeted by unscrupulous third parties attempting to obtain money through false billing scams. Here at MBIP we usually send request for renewal instructions three months ahead of the renewal deadline – any invoices you receive a year in advance of a renewal deadline may be a scam.  In addition to this, we will always advise of renewal fees at the outset of a matter.
